Homestead

There are two types of homestead in Florida.  That which reduces property taxes, and that which protects the primary residence against creditors and other claims.  For estate planning purposes, we are concerned with the second.  This type of homestead property passes outside of probate but requires a probate proceeding to have the property declared homestead.  Being married or having minor children can restrict what can be done with homestead property.

Homestead property can include a house, condo, mobile home, boat and even a leased property.  It can be up to a half acre in a incorporated city or ten acres outside of city limits.
