The state has an interest in protecting the rights of children and has historically placed a limitation on the transfer of homestead property with minor children. No matter what is stated in a will or trust, minor children will retain interest in a homestead property. While these laws have noble origins, they do cause difficulties when planning the estate of parents of minor children.
